(“Company” or “we” or “us”) is committed to protecting your privacy.  We prepared this Privacy Policy to describe our practices regarding the information we collect from users of No Moon Assets including MINDNIGHT (“Service”), and use of our related services, including without limitation our web, mobile, and PC applications.  By submitting information through our website or through our related services, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your information in accordance with this Privacy Policy.

 

When you visit our MINDNIGHT Website, we may track information to administer the site and analyze its usage. Examples of information we may track include:

- Your Internet protocol (IP) address.

- The kind of browser or computer you use.

- Number of links you click within the site.

- State or country from which you accessed the site.

- Date and time of your visit.

- Name of your Internet service provider

- Web page you linked to our site from.

- Pages you viewed on the site.

- In-Game Only: Media Access Control (MAC) Access.

 

When do we collect information?

We collect information from you when you register on our site, subscribe to a newsletter, Open a Support Ticket, contact us or enter information on our site, when you play the game, and/or when you provide us with feedback on our products or services,

We may also collect anonymous demographic information when accessing the website/game to help improve our product - if demographic information is blocked by an extension, that is okay! However, we cannot guarantee full functionality, if blocked.

 

How do we use your information?

We may use the information we collect from you when you register, make a purchase, sign up for our newsletters, respond to a survey or marketing communication, surf the website/play our game, or use certain other site features in the following ways:

     • To personalize your experience and to allow us to deliver the type of content and product offerings in which you are most interested.

     • To improve our website/game in order to better serve you.

     • To allow us to better service you in responding to your customer service requests.

     • To administer a contest, promotion, survey or other site feature.

     • To send periodic emails regarding your order or other products and services.

     • To issue kicks/bans/suspensions in the game

 

How do we protect your information?

We do not use vulnerability scanning and/or scanning to PCI standards.

We only provide articles and information. We never ask for credit card numbers unless it is through a third-party secured site, like Steam.

We do not use Malware Scanning.

 

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

 

We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are processed through a gateway provider (such as Steam) and are not stored or processed on our servers.

Most information is securely stored with on our servers provided by Contabo, which we use for our cloud database.

 

Do we use 'cookies' on the website or store local preferences from the game on your computer?

Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information.

They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

 

We use cookies/local preferences to:

     • Understand and save user's preferences for future visits.

     • Compile aggregate data about site traffic and site interactions in order to offer better site experiences and tools in the future. We may also use trusted third-party services that track this information on our behalf.

Privacy Policy Revisions

There will likely be an iteration of revisions throughout the game’s lifetime. By continuing to use our services, you agree to adhere to the updated revisions. If you do not agree, do not play.

 

Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless we provide users with advance notice. This does not include website/game hosting partners and other parties who assist us in operating our website/game, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when it's release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property or safety.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

 

We also store match records, including chat logs, match history, purchases,and potentially other related logs and reports are uploaded to our database. This is stored for evidence against harassment and/or abuse as well as research to improve MINDNIGHT.

 

Web-hooks

We may periodically create web-hooks from in-game or other services, such as website or forum, that may announce activity. For example, when you start a match, a Discord message may pop-up stating you started a match with accompanying public info.

 

Unity

Steam

We use Steam as convenient way to sign in, among other features. We also use Steam for friend discovery, parties with friends, and other features included within Steamworks. Third-party links

Occasionally, at our discretion, we may include or offer third-party products or services on our website/game. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

 

Google

We use Google Analytics for anonymous demographics to help improve our website/game. Google Analytics is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of websites, to prepare reports on its activities and share them with other Google services.

Google may use the data collected to contextualize and personalize the ads of its own advertising network.

Google Analytics has the following features enabled:

Google, as a third-party vendor, uses cookies to serve ads on our site. Google's use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.

 

We have implemented the following:

We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website.

Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt Out page or by using the Google Analytics Opt Out Browser add on. To opt-out of our newsletter, there is an unsubscribe button on every email.

1.1 Information You Provide Us Directly: We may collect information from you, including, but not limited to your username, first and last name, e-mail, password, phone number, and city and state where you live or work when you create an account to log in to our network or at other times. We retain information that you post or store through your account and/or on our website, including without limitation, comments, notes, and photos.

 

If you exchange any messages through our site or through our service, we may store those as well.  If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply, and any information that you submit to us, such as a resume.

 

When you post your name, data, messages, questions, comments, articles or photos on our website or to our service, the information contained in your posting will be stored on our servers and other users may be able to see it.

 

1.2 Information We May Receive From Third Parties: We may receive information about you from third parties. If you link your Company account to any third party website (e.g. Facebook) we may receive information about you from those sites. For example, if you access our service through a third-party connection or log-in, for example, through Facebook Connect, by linking your account to the Company service, etc., that third party may pass certain information about your use of its service to Company.

 

This information could include, but is not limited to, the user ID associated with your account, an access token necessary to access that service, any information that you permitted the third party to share with us, and any information you made public in connection with that service. If you allow us access to your friends list, your friends' user IDs, and your connection to those friends, may be used and stored to make your experience more social, and to allow you to invite your friends to use our Service as well as provide you with updates if and when your friends join Company.

 

You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to the service. You may also unlink your third party account from the service by adjusting your settings on the third party service and emailing us at legal@nomoon.io.

 

1.3 Information Collected via Technology.  To make our website and related services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

 

We also use Cookies (as defined below) and navigational data to gather information regarding the date and time and duration of your visit and the solutions and information for which you searched and which you viewed.  This information includes, without limitation, characters you type, your search and browsing history, articles you click, and pages you view.  Like most Internet services, we automatically gather this information and store it in log files each time you visit our website or access your account on our network.

 

“Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site.  We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our website.  Persistent Cookies can be removed by following Internet browser help file directions.  If you choose to disable Cookies, some areas of our website or service may not work properly.  We may also collect precise location information in order to enhance your use of the services.

 

1.4 Do Not Track.  Neither we nor any third parties who push content to our site respond to browser-based "do not track" signals.

2.1 General Use.  In general, information you submit to us is used either to respond to requests that you make, or to aid us in serving you better.  Company uses your information for research and marketing purposes; to facilitate the creation of and secure your account on our network; identify you as a user in our system; provide improved administration of our website and services; improve the quality of experience when you interact with our website and services; send you administrative e-mail notifications; respond to your inquiries related to employment opportunities or other requests; send promotional communications; send upgrades and special offers related to our services and for other marketing purposes of Company or our third party companies; make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback.

 

2.2 Creation of Anonymous Data.  We may create anonymous data records from information by excluding information (such as your name) that makes the data personally identifiable to you.  We use this anonymous data to analyze request and usage patterns so that we may enhance the content of our services and improve site navigation.  Company reserves the right to use and disclose anonymous data to third party companies for any purpose in its discretion.

 

2.3 Feedback.  If you provide feedback on any of our services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your information.  Company will collect any information contained in such communication and will treat the information in such communication in accordance with this Privacy Policy and Terms of Use.

 

3. Disclosure of Your information

 

3.1 Affiliates.  Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future.  We may share some or all of your information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.  If another company acquires our company or our assets, that company will possess the information collected by it and us and will assume the rights and obligations regarding your information collected by us as described in this Privacy Policy.

 

3.2 Other Disclosures.  Regardless of any choices you make regarding your information (as described below), Company may disclose information if it believes in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on Company; or (b) protect or defend the rights or property of Company or users of the services.

 

3.3 Disclosure to Third Party Service Providers.  We may share your information with third party service providers to provide you with the services that we offer you; to conduct quality assurance testing; to facilitate creation of accounts; to facilitate your use of the service; to process any transactions you make through our website or service, or to provide technical support.

A third party company may want access to information that we collect from you and we may share such information with a third party on an anonymous basis.  If you link your Company account to any third party website (e.g. Facebook) we may share information about you with those third parties. 3.5 Notice to California Residents - Your California Privacy Rights (As Provided by California Civil Code section 1798.83).  A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.

 

 In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal data was disclosed in the preceding calendar year, as well as a list of the categories of personal data that were disclosed.  California Customers may request further information about our compliance with this law by e-mailing legal@nomoon.io.  Please note that we are required to respond to one request per California Customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

 

4. Third party websites.

We may link to or frame third party websites. Our provision of a link to or frame of any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents.  When you click on such a link, you will leave our site and go to another site.  If we display third party websites through a frame, you are on another site.

 

During this process, another entity may collect information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content.  Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or framed websites, or to any collection of data after you click on links to such outside websites.

 

5. Your Choices Regarding Your information

 

5.1 Choices.  We offer you choices regarding the collection, use, and sharing of your information.  We will periodically send you free newsletters and e-mails that directly promote the use of our site or services and may contain advertisements for third party companies.  When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below).  Should you decide to opt-out of receiving future mailings, we may share your e-mail address with third parties to ensure that you do not receive further communications from third parties.

 

Despite your indicated e-mail preferences, we may send you emails related to your account or transactions thereunder, or notices of any updates to our Terms of Use or Privacy Policy.

 

5.2 Changes to information.  You may change any of your information in your account by sending an e-mail to us at legal@nomoon.io or by editing your profile on the site.

 

You may request deletion of your information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).  When we delete any information, it will be deleted from the active database, but may remain in our archives. Our service offers publicly accessible community services. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you cancel your account.

 

6. Security of Your information.

We are committed to protecting the security of your information.  We use a variety of industry-standard security technologies and procedures to help protect your information from unauthorized access, use, or disclosure.  Despite these measures, you should know that we cannot fully eliminate security risks associated with information and mistakes may happen.

 

7. Dispute Resolution.

We will do our best to address your concerns.  If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation.  If you and Company are unable to reach a resolution to the dispute, you and Company will settle the dispute exclusively under the rules of the American Arbitration Association (www.adr.org) as set forth in the Terms of Use.

 

8. A Note About Children.

We do not intentionally gather information about visitors who are under the age of 13. If you are under the age of 13 you should not use our site or service.

 

9. A Note to Users Outside of the United States.

Your information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of information may be less stringent than the laws in your country.
